This Returns and Claims Policy governs the conditions applicable to returns, complaints, and product-related incidents concerning items marketed under the Avialovers brand, operated by Asterisco Amarelo Lda, a company duly incorporated under Portuguese law. By placing an order, the customer expressly acknowledges and accepts the intermediary, artistic licensing, and print on demand nature of the platform’s operating model.

Avialovers operates as a digital platform dedicated to artistic licensing and technological management. The physical products offered through the platform are manufactured on demand by independent third party production partners only after an order has been confirmed. Each item is produced specifically for the customer and incorporates an original artistic design owned by Asterisco Amarelo Lda or used under valid licensing agreements with third parties. In accordance with applicable European consumer protection legislation, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized. As such, returns based on change of mind, incorrect size selection, subjective preferences, or any reason not related to an objectively verifiable defect will not be accepted.

Claims will only be considered where the product presents clear manufacturing defects, production or transport related damage, or where the item received materially differs from the confirmed order. The customer must notify the company within seven calendar days of delivery by sending a formal communication to info@asteriscoamarelo.com, attaching clear and complete photographic evidence of both the product and its original packaging. Asterisco Amarelo Lda reserves the right to request additional information necessary for proper assessment. Failure to provide sufficient documentation may result in rejection of the claim.

Once the incident has been duly verified, Asterisco Amarelo Lda, acting in its capacity as platform operator and intermediary, will coordinate with the external production partner to determine an appropriate resolution. Such resolution may, at the sole discretion of the company, consist of product replacement or full or partial refund of the amount paid. The handling of any individual claim shall not constitute a general admission of liability beyond the specific case evaluated.

Size selection is the sole responsibility of the customer. Avialovers provides size guides for informational purposes to assist in making an informed decision. Exchanges or returns resulting from customer selection errors will not be accepted.

Minor variations in color, tone, scale, or final finish between the images displayed on the platform and the delivered product shall not be considered defects, as such differences may result from screen calibration, technical printing processes, or the inherent characteristics of the materials used in on demand production.

If the customer provides an incorrect, incomplete, or inaccurate shipping address, Asterisco Amarelo Lda shall not be held liable for losses, delays, or returns resulting from such information. Should a package be returned due to customer related address errors, any reshipment will be subject to additional costs to be fully borne by the customer.

For purchases made through external platforms or marketplaces, including but not limited to Amazon, returns and refunds shall be subject to the policies and procedures of the respective platform. Asterisco Amarelo Lda will act in accordance with the applicable marketplace rules, without altering the intermediary nature of its operating model.

Under no circumstances shall the maximum liability of Asterisco Amarelo Lda exceed the amount actually paid by the customer for the product subject to the claim. The company expressly excludes liability for indirect damages, consequential losses, loss of profits, or any other damages arising from the use or inability to use the purchased product.

Asterisco Amarelo Lda reserves the right to reject claims where there are reasonable indications of fraud, abuse of the returns system, improper use of products, or conduct detrimental to the operational integrity of the platform.

This Policy shall be governed by and construed in accordance with the laws of Portugal. Any dispute arising from its interpretation or execution shall be subject to the jurisdiction of the competent courts of Portugal, without prejudice to any mandatory consumer rights under applicable European legislation.
