RETURNS AND CLAIMS POLICY
This Returns and Claims Policy governs the conditions applicable to returns, complaints, and product related incidents concerning items marketed under the Avialovers brand and operated by Asterisco Amarelo Lda, a company duly incorporated under Portuguese law.
By placing an order, the customer acknowledges and accepts the print on demand and artistic licensing nature of the platform’s operating model.
- BUSINESS MODEL
Avialovers operates as a digital platform dedicated to artistic licensing, design management and technological coordination. Physical products are manufactured on demand by independent third party production partners only after an order has been confirmed. Each item is produced specifically following the customer’s selection and incorporates original artistic designs owned by Asterisco Amarelo Lda or used under valid licensing agreements.
- RIGHT OF WITHDRAWAL
In accordance with applicable European consumer protection legislation, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized.
As Avialovers products are manufactured on demand following the customer’s specific selection of design, size, color and format, they fall within this legal exception. Therefore, returns based on change of mind, incorrect size selection, or subjective preference will not be accepted.
This clause does not affect mandatory consumer rights in cases of defective or non conforming goods.
- DEFECTS AND NON CONFORMITY
Claims will be considered exclusively where
• The product presents a clear manufacturing defect
• The product was damaged during production or transport
• The item received materially differs from the confirmed order
The customer must notify the company within seven calendar days from delivery by sending a formal communication to info@asteriscoamarelo.com and attaching clear photographic evidence of the product and its original packaging.
Asterisco Amarelo Lda reserves the right to request additional information necessary for proper assessment. Failure to provide sufficient documentation may result in rejection of the claim.
- RESOLUTION OF CLAIMS
Once the issue has been verified, Asterisco Amarelo Lda will coordinate with the relevant production partner to determine an appropriate solution.
The resolution may consist of
• Replacement of the product
• Full refund
• Partial refund where proportionate
The chosen solution will be determined based on the specific circumstances of the case and in accordance with applicable consumer protection law.
The handling of any individual claim shall not constitute a general admission of liability beyond the specific case evaluated.
- SIZE SELECTION
Size selection is the sole responsibility of the customer. Size guides are provided for informational purposes only. Returns or exchanges resulting from customer selection errors will not be accepted.
- PRODUCT VARIATIONS
Minor variations in color, tone, scale or final finish between the images displayed on the platform and the delivered product shall not be considered defects. Such variations may result from screen calibration differences, printing processes or material characteristics inherent to on demand production.
- SHIPPING INFORMATION
Customers are responsible for providing accurate and complete shipping information. Asterisco Amarelo Lda shall not be liable for losses, delays or returns resulting from incorrect or incomplete address details provided by the customer.
If a package is returned due to customer related address errors, any reshipment will be subject to additional shipping costs borne by the customer.
- RETURN ADDRESS
Where a return is authorized following verification of a valid claim, the product must be sent exclusively to the return address indicated on the delivery note included with the order.
The return address is printed on the original packing slip and corresponds to the designated production partner responsible for fulfillment.
Under no circumstances shall products be returned to Asterisco Amarelo Lda’s registered office address unless expressly instructed in writing.
Returns sent to an incorrect address without prior authorization may not be processed and may result in rejection of the claim.
- MARKETPLACE SALES
For purchases made through external platforms or marketplaces, including Amazon, returns and refunds shall be governed by the respective marketplace’s policies and procedures. Asterisco Amarelo Lda will act in accordance with the applicable platform rules.
- LIMITATION OF LIABILITY
To the extent permitted by law, the maximum liability of Asterisco Amarelo Lda shall not exceed the amount paid by the customer for the product subject to the claim.
The company excludes liability for indirect damages, consequential losses or loss of profits arising from the use or inability to use the product, except where such limitation is not permitted under applicable law.
- FRAUD AND ABUSE
Asterisco Amarelo Lda reserves the right to reject claims where there are reasonable indications of fraud, abuse of the returns system, improper use of products or conduct detrimental to the operational integrity of the platform.
- GOVERNING LAW
This Policy shall be governed by the laws of Portugal. Any dispute arising from its interpretation or execution shall be subject to the jurisdiction of the competent courts of Portugal, without prejudice to mandatory consumer rights under applicable European Union legislation.
